Strong Representation For SSDI And SSI Benefits

Many individuals suffer from disabilities, illnesses and injuries that impact their lives significantly. They may need extensive medical care and spend a great deal of time focused on getting the treatment they need. Often, their conditions are so severe that they are unable to work, and face hardships making ends meet.

Fortunately, there are options available to individuals who find themselves in such a situation. Most people who have worked for an employer or have been self-employed over the previous 10 years will be eligible to receive pay benefits from the federal Social Security Disability Insurance (SSDI) program if they suffer a qualifying disability that makes them unable to work (which can be physical or mental in nature.)

The SSDI attorneys at Nicolet Law Office can help you learn more about the options available to you if you are struggling with such a disability. Our Social Security Disability lawyers will work with you to help you determine the next steps to take to ensure that you get the benefits you need while dealing with your injury or illness.

How Do You Know If You Qualify For Social Security Disability Benefits?

Whether you qualify is determined by the Disability Determination Services of your local Social Security Administration (SSA) office. You fill out an extensive application with the SSA to begin the disability benefits claims process. You need to supply extensive medical documentation, which proves that you have a condition that meets the qualifications the agency has set out before benefits will be awarded.

Unfortunately, initial requests for Social Security benefits are often denied. The SSA frequently rejects initial claims for technical issues, such as missing or incomplete information. Don’t give up. If your initial request is denied, know that you have options.

You can appeal the decision and have a hearing with an administrative law judge who will review your disability case more closely. The appeal process can be long and complicated, and it is important to have a lawyer who understands how things work to help you get the benefits you deserve.

Our law firm can assist with many different aspects of a Social Security disability claim. Under the leadership of attorney Russell Nicolet, our attorneys will review your case and, if necessary, file an appeal to have someone take a second look at your case. We will stand by your side, working hard to keep things moving forward.

What Is SSI?

For individuals who do not have the work history necessary to qualify for SSDI, another government program exists to provide financial assistance. For those who meet the minimum financial requirements and struggle with a qualifying disability, Supplemental Security Income (SSI) was developed to ensure future financial stability. If you have questions about your qualifications or the SSI requirements in general, do not hesitate to schedule a free consultation with an experienced attorney.

What Happens If A Parent Who Was Receiving Benefits Dies?

Upon the death of a disabled worker who was receiving benefits, a qualifying child or children may be eligible to receive benefits. Qualifications for child survivor benefits include:

  • Child(ren) must be of minor age – under 18
  • Children over 18 may be eligible if they suffer a disability diagnosed prior to age 22
  • A child over 18 may qualify if he or she is still in high school and under the age of 19

People who qualify for SSDI benefits have paid into the federal program through Social Security taxes.

In addition to disability benefits, the SSA provides survivor benefits to the surviving spouse and qualifying children of individuals who were receiving benefits at the time of death. Qualifying eligibility requirements are very specific. Having the right attorney on your side will often make the difference in how quickly your claim is processed and whether your benefits will be denied or approved.

What About Cases Involving Private Disability Insurance?

Some individuals buy supplemental insurance or are provided it by their employers that would give them additional income in the event they suffer from a long-term or short-term disability. The insurance carriers involved often make it extremely difficult for someone to get the benefits they are entitled to under their policy.

At our law firm, we have extensive experience handling private disability claims. If you carry private disability insurance coverage and have been denied by your insurance company, we can also help you appeal disability insurance claims for benefits.
