Frequently
Asked Questions
What Can a Personal Injury Lawyer Do for Me?
In general, your personal injury lawyer can help relieve the stress you are experiencing after an accident resulting in serious injuries and fight for the compensation you need to recover.
Specifically, a skilled and compassionate attorney will investigate your claim, negotiate with insurance companies on your behalf, prepare and present your claim or lawsuit, and ensure your legal rights are protected. The best Wisconsin personal injury lawyers can provide peace of mind while you focus on your physical and emotional recovery.
When Should I Contact a Personal Injury Lawyer?
The sooner you meet with an experienced personal injury lawyer, the more protection you’ll have and the better you’ll feel. At Nicolet Law, we are happy to meet with you for a free consultation anytime and anywhere that is convenient for you. You will learn more about the personal injury claim process and have all your questions answered during a no-obligation meeting with our team. Then we can start our investigation and deal with the insurance adjusters on your behalf while you focus on your family and your recovery.
If you have already filed a claim or talked to an insurance adjuster, it’s not too late. We can step in to help protect your rights at any point before you sign a final release and settlement. Don’t wait any longer. Contact us for a free consultation today.
What is My Personal Injury Claim Worth?
This is a complicated and very personal question that can only be answered after we learn more about your unique situation. Once we understand how your accident occurred, who is at fault, the injuries you sustained, the losses you incurred and expect to incur, and your future prognosis, we can estimate a fair settlement amount for your claim. And you won’t have to pay a penny for this information because we offer a free case consultation where we can learn all about you and ensure we answer your questions completely.
What Type of Compensation Can I Request?
If your injury occurred in Minnesota, you must file a claim against your own Personal Injury Protection (PIP) insurance company which limits the compensation you can receive. However, in addition to the PIP laws, you may also be able to bring a claim against the at-fault party’s insurer in some cases.
Wisconsin does not require PIP coverage, so you may bring your initial claim against the responsible person’s insurance company for your losses. If you have a viable personal injury claim, you can request payment for two types of losses, known as legal damages.
Economic damages may include current and future lost wages and income, current and future medical expenses, and other out-of-pocket expenses related to your injuries.
Non-economic damages could include pain and suffering, emotional or mental anguish such as PTSD, loss of a normal life or family relationships, and other losses that are more difficult to calculate.
An experienced personal injury lawyer at Nicolet Law can explain which losses you may be able to recover in your particular circumstances.
How Long do I Have to File a Claim/Lawsuit?
Each state sets a time limit for filing a personal injury lawsuit. These Statutes of Limitation are different from state to state. In Minnesota, an injured person has six years from the date of the accident that caused the injuries to bring a lawsuit to recover damages. Wisconsin allows an accident victim up to three years from the date of the incident that caused the injuries to file a lawsuit.
There are exceptions to these rules, and you can’t afford to miss a filing deadline by accident. A knowledgeable personal injury lawyer can tell you exactly how long you have to file your court action, so you don’t miss your chance. During this period of time, your attorney should be investigating and preparing your case while negotiating your claim with the insurance companies to see if you can settle your case without having to go to court.
