No one plans to get in an accident, and Grand Rapids drivers often stress over how they will afford their recovery.
If you or a loved one in Kent County is dealing with the aftermath of an accident and struggling to make ends meet, you're not alone. Unfortunately, while car accident victims are grappling with what to do next, the insurance companies they interact with handle car accident cases as a business. The lower they keep their offers, the better their business does.
A Grand Rapids car accident attorney from Nicolet Law can help you recover and take on the insurance companies, so that you can focus on what matters most: getting better. For the full breakdown of Michigan's no-fault system, PIP levels, and what the tort threshold means across all claim types, see our Michigan car accident lawyers page.
Michigan insurance rules can be confusing, and they were recently reformed, meaning that many are understandably unaware of the full impact of the new rules. No one struggling with pain and worry should have to deal with all the headaches that a car accident case can bring alone.
On this page, we'll cover how Michigan's no-fault system pays, what the injury threshold requires, how winter conditions affect a fault argument, and how a lawyer can help.

Grand Rapids Car Accident Lawyer Statistics
Kent County is Michigan's second-largest crash county, and the state and city figures are published in full.
- Kent County recorded 19,214 crashes, 56 fatal crashes, 58 deaths, 3,676 injury crashes, and 4,942 injuries in 2025, on the Kent row of the Michigan State Police 2025 County Crash Report (county level).
- The city of Grand Rapids recorded 5,575 crashes, 18 fatal crashes, 19 people killed, and 1,684 injured in 2024, on the city table in the Michigan Traffic Crash Facts 2024 traffic crash summary (city level).
- Michigan recorded 290,221 crashes and 1,065 traffic deaths statewide in 2025, per the Michigan State Police 2024 to 2025 comparison (state level), with 5,781 people suffering suspected serious injuries in 2024 per the Michigan Traffic Crash Facts general facts report.
- Kent County ranked third in Michigan for winter-weather crashes with 1,315 and fourth for distracted-driving crashes with 1,264 in 2024, in the Michigan Traffic Crash Facts 2024 fact sheets (county level). Those two categories drive most of the fault disputes we see here.
- Michigan drivers paid an average of $1,443.45 for auto insurance in 2023, against a national average of $1,281.60, on Table 4 of the National Association of Insurance Commissioners premium supplement (state and national).
Behind each of these numbers is a household dealing with hospital bills, missed paychecks, and a claim that may not be moving forward. If a car accident in Grand Rapids has changed your daily life, a Grand Rapids car accident lawyer from Nicolet Law can investigate what happened, handle the insurance companies, and pursue a claim that reflects the full impact of your injuries.
Which PIP Coverage Level Do You Actually Have?
Whatever the named insured selected at issue or renewal after July 1, 2020, and it is written on the policy. MCL 500.3107c lists the options, and the difference between the top and bottom options is the difference between lifetime medical care and a bill that outlives the coverage.
| Level | Eligibility | What it usually means in a serious Kent County crash |
|---|---|---|
| Unlimited | Any driver | Allowable medical expenses for life, the pre-2020 Michigan standard |
| $500,000 | Any driver | Generally adequate outside catastrophic injury |
| $250,000 | Any driver | A single long hospitalization can approach the limit |
| $50,000 | Only if the named insured is enrolled in Medicaid, with conditions on household members | Frequently exhausted within days of a severe crash |
| No PIP | Only a qualified person with Medicare Parts A and B, under MCL 500.3107d | Care runs through health insurance instead |
What the default rule is if nobody chooses
If no effective selection was made and no premium-based presumption applies, MCL 500.3107c makes unlimited coverage the default.
Why the limit matters after it runs out
When your PIP limit runs out, the excess medical expenses and wage loss can be pursued from the at-fault driver under MCL 500.3135. That head of damages barely existed in Michigan before the reform, and it is now often the largest part of a serious claim. The Michigan Department of Insurance and Financial Services no-fault guidance explains the consumer framework.
Who Is at Fault for a Crash on Snow or Ice?
A driver can still be at fault in a snowstorm, and "the road was slick" does not excuse driving that did not accommodate for the weather.
Weather is a factor, not a defense
Michigan drivers have a duty to operate at a speed that is reasonable for actual conditions, not just at or below the posted limit. In practice, winter crashes in Kent County turn on following distance, speed relative to visibility, tire condition, and whether the driver was doing something else at the same time.
How partial fault changes the math
Fault is also rarely all or nothing. Under MCL 600.2959, your damages are reduced by your percentage of fault, and if you are found more than 50 percent at fault, non-economic damages are barred while economic damages remain recoverable, reduced by your share.
Is a passenger's claim ever questioned?
Even in a strong position, the position still gets reviewed. Insurers may ask about seat belt use, about whether anyone in the car affected the driver's attention, and about what each occupant knew about the driver's condition before the trip. Those are standard questions in these files, ones that a lawyer will be better prepared to answer than a passenger.
What Injury Is Serious Enough for an At-Fault Claim in Michigan?
For economic damages, any amounts exceeding PIP limits can be sought through an at-fault claim.
For non-economic damages, one must clear the statutory threshold in MCL 500.3135: death, permanent serious disfigurement, or a serious impairment of body function. The 2019 amendments put the definition in the statute, and it has three parts. The impairment must be objectively manifested, meaning observable or perceivable by someone other than you. It must affect an important bodily function. And it must affect your general ability to lead your normal life.
There is no minimum duration and no requirement of permanence. What there is, in reality, is a documentation fight. Two people with identical MRI findings can end up with very different outcomes depending on whether their medical records describe specific functional limitations or just report pain. That is one of the concrete places a lawyer changes the value of a claim by making sure the record reflects what you actually cannot do.
Michigan also has a small separate remedy for vehicle damage. The mini-tort provision in MCL 500.3135(3)(e) allows recovery of up to $3,000 from the at-fault driver for vehicle damage that insurance did not cover, for crashes after July 1, 2020. It does not require a threshold injury, and it is not a substitute for an injury claim.
What makes an early offer look better than it is
Early offers are usually made before anyone knows how the injury settles out. An adjuster who has your emergency room bill but not your surgeon's opinion is valuing a file that is only half built. We hold the claim open until the treatment record shows the actual limitations, then negotiate from that record.
What Is the Filing Deadline for a Grand Rapids Car Accident Claim?
One year for no-fault benefits, three years for the claim against the at-fault driver, and the one-year rule has a second half that can cost people money. Under MCL 500.3145, a suit for PIP benefits generally cannot be filed more than one year after the crash unless written notice of injury was given to the insurer within that year or the insurer already paid benefits.
Separately, even a timely PIP suit recovers only benefits incurred in the twelve months before filing. Delay does not postpone those benefits. It can cause them to be lost, month by month.
The claim against the at-fault driver runs for three years under MCL 600.5805(2).
If a road condition or a government vehicle was involved, shorter notice requirements and deadlines may apply, including the 120-day notice period for many road defect claims under MCL 691.1404. Each deadline can have exceptions, and none of them should be assumed. A short conversation with a lawyer early on can avoid significant problems later on.
If it has been months since your crash and your benefits are not being paid, that clock is a problem worth addressing now. Call 1-855-NICOLET or contact us online for a free consultation. You do not pay attorney's fees unless we recover money for you.
What Does a Grand Rapids Car Accident Lawyer Actually Do?
There are many moving parts in a case, but here are six key components.
Investigate
We can obtain the crash report, photograph the scene and vehicles, identify and interview witnesses, and request commercial video along the corridor before it is overwritten, which often happens within days.
Open and defend the benefit claim
We can put the PIP carrier on notice properly, get medical bills routed correctly, pursue work loss and replacement services, and challenge denials of treatment as not reasonably necessary.
Build the medical record
We can work with treating providers so the chart documents functional limitations, obtain prior imaging when pre-existing conditions are raised, and retain qualified physicians to address causation when it is contested.
Find every layer of coverage
We can read the policies. Michigan does not require uninsured or underinsured motorist coverage, and the state's auto insurance guide lists both as optional, so identifying whether it exists and what its conditions say matters before anyone signs a release.
Value and negotiate
We can calculate future care and lost earning capacity with support, then negotiate from a documented position rather than a demand letter.
Litigate when necessary
Filing suit is sometimes the only way to obtain information or move an insurer that has stopped negotiating. Many car accident cases never make it to the courtroom. Even after we file suit, insurance adjusters can make acceptable final offers, keeping the courtroom at bay.
Nicolet Law has recovered more than $500,000,000 for clients. Some of our attorneys used to work for the insurance industry, and we also have registered medical professionals on staff who review the treatment record before we value anything. That means that our firm has a unique and crucial perspective on what it takes to build a strong case. We build each file as though it will be tried.

FAQs About Grand Rapids Car Accident Lawyers
My PIP limit ran out. Am I stuck with the rest of the bills?
Not necessarily. Michigan allows recovery of excess medical expenses and wage loss from the at-fault driver when your losses exceed the PIP coverage level on your policy, under MCL 500.3135(3)(d). That claim is separate from pain and suffering, and it has its own proof requirements. Identifying it early can change how the whole case is built.
My PIP carrier says my treatment is not reasonably necessary. What now?
That is a benefit dispute, and it is contestable. The path forward usually involves treating-physician documentation and, if the carrier will not move, a claim for benefits under MCL 500.3145. The one-year rules make timing important here.
The other driver was from out of state. Does Michigan no-fault still apply?
Generally yes, for a crash that happens in Michigan, and the coverage analysis gets more complicated. Out-of-state policies interact with Michigan's no-fault system in ways that depend on the insurer's certification and the vehicle's use, and injured Michigan residents usually still claim PIP through the priority rules. This is worth having someone map out rather than guessing at.
Do I have to use the body shop the insurer recommends?
No. You choose the repair facility, and steering pressure toward a preferred shop is common. Property damage is a separate track from your injury claim, though the repair estimate and photographs are useful evidence about impact severity, which is why we ask for them before repairs begin.
Is a rear-end collision automatically the other driver's fault?
Usually, but not automatically. Following too closely is the common cause of accidents, but insurers may still argue sudden stops, non-functioning brake lights, and chain-reaction sequences in multi-car crashes. Those arguments rely on physical evidence, damage patterns, and, where available, vehicle event data.
What if I felt fine at the accident scene but I hurt now?
That is extremely common, and it does not defeat a claim. Soft tissue injuries and concussions often declare themselves over the following days, and adrenaline masks a great deal in the first hours. What matters is getting evaluated promptly, since a long gap between the crash and the first medical visit does give insurance companies room to argue that the crash and the injury are not related.
