Health Conditions Resulting From Dangerous CPAP Use

In June 2021, Philips Respironics issued a voluntary recall of CPAP and BiPAP devices due to the use of polyester-based polyurethane foam used in the devices. The foam should reduce vibration and sound, which can, in turn, lead to more comfortable sleeping arrangements for both CPAP and BiPAP users and their partners or others sharing a room with them.

Over time, this foam content can break down and release either foam particles or invisible chemicals. The person using the device can then breathe in those chemicals or even physical foam pieces. The toxic chemicals used in polyurethane foam production can pose several dangers to the user.

Immediate Impact

As soon as the foam breaks down and the user inhales or ingests it, it can cause damaging symptoms. Exposure to those toxic chemicals can lead to headaches and inflammation throughout the body. It may also cause hypersensitivity to other stimuli, making it more difficult to isolate specific symptoms. Furthermore, chemical exposure may cause nausea and vomiting over time.

Respiratory Issues

Exposure to toxic chemicals released from polyurethane foam can lead to respiratory issues, including overall respiratory sensitivity or decreased lung capacity. Patients who already suffer from respiratory issues, including asthma, may notice their lungs become more sensitive or have increased respiratory challenges due to exposure to those toxic chemicals. Respiratory challenges can, in some cases, influence both work and leisure activities.

Cancer Risk

Exposure to the chemicals released during polyurethane breakdown can increase the risk of several types of cancer. Cancer may vary based on chemical exposure and personal sensitivity. However, cancer may permanently change many aspects of the victim’s life, including the victim’s ability to engage in everyday activities or take care of work tasks.

Nicolet Law Accident & Injury Lawyers Can Help CPAP and BiPAP Users Impacted by Toxic Chemical Exposure

When you face a devastating diagnosis because of toxic chemical exposure because of your CPAP or BiPAP use, you may have the right to compensation. Nicolet Law Accident & Injury Lawyers can offer vital assistance as you move forward with a claim against Philips Respironics.

We can help you establish the connection between CPAP or BiPAP use and your diagnosis.

As indicated by the voluntary recall, Philips Respironics does know about the potential link between toxic chemical exposure in their CPAP and BiPAP products and the diagnoses users may face. However, you may need to establish a link between your use of those products and your diagnosis to participate in a lawsuit against the manufacturer.

At Nicolet Law Accident & Injury Lawyers, we can help show how your CPAP or BiPAP use may have led to devastating diagnoses or symptoms that could have impacted your everyday use.

We help our clients display how their diagnosis impacted them financially and non-financially.

Often, a serious diagnosis, including those linked to toxic chemical exposure from CPAP or BiPAP use, can have substantial financial repercussions for the user. Not only that, those diagnoses can impact non-financial areas of your life.

For example, if you face a cancer diagnosis, it can have a long-term impact on your overall quality of life, including leading to a decreased overall enjoyment of life. At Nicolet Law Accident & Injury Lawyers, we help our clients break down the impact toxic chemical exposure has had on them so they can include those damages as part of an injury claim.

We also make sure our clients know what an effective settlement might look like so that they will find themselves in the best possible position to negotiate for the full compensation they may deserve.

We fight to help our clients pursue justice for their losses.

When you chose to use a Philips Respironics product to treat your sleep apnea, often because of your doctor's instructions, you may have trusted that the product would solve many of your sleep-related problems.

Unfortunately, a product that releases toxic chemicals directly into the air breathed throughout the night can have more negative impacts than anticipated. You may find yourself struggling to cope with the limitations created by those products and the financial ramifications that often go along with them.

At Nicolet Law Accident & Injury Lawyers, we help our clients fight for the justice they deserve, whether that means negotiating with the manufacturer, putting together their claim, fighting for the compensation they may deserve, or going to court to help our clients recover the full compensation they need for injuries the medical device caused.

However, we can help look at the severe diagnoses you may have faced and the challenges you may have sustained due to those diagnoses, including your full financial losses.

Compensation for Your Medical Bills

Inhaling the toxic chemicals released due to polyurethane breakdown may result in considerable medical bills over time. As part of your claim, you can include compensation for those often high medical bills.

You may want to take into consideration:

  • Diagnostic exams and visits may identify your symptoms and diagnose you. In some cases, you may have gone through multiple visits to diagnose your ailments and determine their potential cause.
  • Treatment for your diagnosis. In the case of a cancer diagnosis, for example, you might require chemotherapy or radiation treatments to improve your quality of life and increase your odds of beating cancer.
  • Durable medical equipment, particularly when cancer treatments cause ongoing weakness and you require additional assistance.
  • Hospital stays.
  • In-home care assistance, particularly if you require ongoing care during cancer treatments.

Talk to your lawyer about any medical costs you have faced because of potential toxic chemical exposure. You may also want to discuss possible future medical expenses. For example, in the case of a cancer diagnosis, you may need treatment for some time after the initial diagnosis.

Compensation for Income Loss

The symptoms of toxic chemical exposure due to polyurethane breakdown may make it impossible for you to work. Ongoing headaches, for example, can interfere substantially with productivity and even have you calling off work because of your symptoms.

If you face a devastating diagnosis, including a cancer diagnosis, you may find it even more challenging to go back to work. In some cases, you may have to take off work while you undergo cancer treatments. In other cases, you may find that your cancer diagnosis permanently prevents you from returning to your former profession, leaving you with a range of ongoing challenges.

As part of your claim, you can include compensation for the wages you lost due to your diagnosis or for the earning potential you no longer have because of the diagnosis. A lawyer can help you determine your next steps, including how to best recover compensation for your lost wages.

Compensation for Your Suffering

Some patients find that their toxic chemical exposure causes immense, ongoing suffering. You may, for example, find it very difficult to engage in your everyday activities, including the ones that brought you the most joy before your diagnosis. Toxic chemical exposure may cause ongoing health problems or interfere with your overall quality of life following a devastating cancer diagnosis. A lawyer can lay out how toxic chemical exposure and its diagnoses may have affected your life and the compensation you deserve.

If you lost a loved one to a devastating diagnosis following toxic chemical exposure related to polyurethane breakdown in a CPAP or BiPAP machine, your family might have the right to pursue compensation for the loss of that loved one. Your family has the right to file one claim against the manufacturer to recover compensation for your loved one’s loss.

You may recover compensation for:

  • Your loved one’s final medical expenses
  • Your loved one’s pain and suffering
  • Your loved one’s funeral and burial expenses
  • The loss of your loved one’s income
  • The loss of the services your loved one performed for the family, including services like child or elder care
  • The loss of your loved one’s presence/the relationship you should have had with your loved one
